In Store Surveillance Cameras

Over my many years of practice, I have seen any number of clients who have fallen in large box stores due to unsafe conditions or hazards. Many of these falls have resulted in serious and lifelong injuries. Our first human response to a fall is embarrassment. When clients get past that, they should be aware of information gathering that may be helpful if a legal claim is warranted. A photo of the defect or the names of witnesses are helpful. In-store surveillance is another good source of information on the cause of falls.
Large stores have any number of cameras with the ability of detailed magnification. Strangely, in many of our cases, even if we seek production of the surveillance video after a legal action is commenced, we are unable to obtain it, for various reasons provided by the store. At a minimum then, clients should ask if the fall was captured on video. This can be done with a store manager or supervisor. If the store agrees that it was, the store will have to clearly explain why it could not be produced.
